This Privacy Policy describes how Token Wallah ("we", "us", or "our") collects, uses, and shares information when you use our mobile application and services.

1 Information We Collect

We collect the following types of information to provide and improve our services:

  • Personal Information: Name, phone number, and email address provided when generating a token.
  • Usage Data: App interactions, session duration, feature usage, and device information.
  • Device Information: Device model, operating system version, and unique device identifiers.
  • Location Data: General location to help find nearby queues (only when permission is granted).

2 How We Use Your Information

  • To generate and manage your queue token
  • To send notifications about your queue status
  • To improve app performance and user experience
  • To provide customer support
  • To comply with legal obligations

3 Data Sharing

We do not sell your personal information. We may share data with:

  • Service Providers: Third-party vendors who assist in operating our app (e.g., cloud hosting, analytics).
  • Business Partners: Shops and businesses whose queues you join — only the data needed for queue management.
  • Legal Requirements: When required by law or to protect our rights.

4 Data Retention

We retain your personal data for as long as necessary to provide our services. Token history is retained for 90 days. You may request deletion at any time via the Data Deletion page.

IMPORTANT — PLEASE READ CAREFULLY: By downloading, installing, or using the Token Wallah / QueueSmart application, you agree to be legally bound by these Terms and Conditions. If you do not agree, you must not use the App.

1 Parties & Definitions

  • "Company" / "We" / "Us": RMSS Innovations, the owner and operator of the Token Wallah / QueueSmart platform.
  • "App": The QueueSmart mobile or web application and all associated services provided by RMSS Innovations under the Token Wallah brand.
  • "User" / "You": Any individual or entity who accesses or uses the App in any capacity.
  • "Queue Token": A digital position ticket issued by the App to a User for a particular service queue session.
  • "Subscription Plan": Any paid access tier to premium features of the App, as defined and priced by the Company from time to time.
  • "Free Trial": The one (1) month complimentary access period granted to new Users upon first account activation, as described in Section 6.
  • "Business / Merchant": Any registered entity or individual that uses Token Wallah to manage customer queues and appointments.

2 Acceptance of Terms

By accessing or using the App, you confirm that:

  • You are at least 13 years of age, or the legal age of majority in your jurisdiction, whichever is higher.
  • You have the legal capacity to enter into a binding agreement.
  • You have read, understood, and agree to be bound by these Terms in their entirety, together with our Privacy Policy.
  • If you are using the App on behalf of an organization or business, you represent that you have authority to bind that entity to these Terms.

3 Description of Service

Token Wallah / QueueSmart provides a digital queue management platform enabling:

  • Businesses and merchants to create, manage, and track customer queues digitally.
  • Users to generate digital queue tokens, monitor their position in real time, and receive estimated wait-time notifications.
  • Integration of appointment scheduling, queue analytics, and customer communication tools.
  • Access to services via mobile application, web browser, and approved third-party integrations.

The Company reserves the right to modify, suspend, or discontinue any feature of the App at any time with or without prior notice.

4 User Accounts & Security

  • You must provide accurate, current, and complete information when creating an account and keep it updated at all times.
  • You are solely responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • You must notify us immediately at contact@tokenwallah.in upon discovering any unauthorized use of your account.
  • The Company is not liable for any loss or damage arising from unauthorized account access caused by your failure to safeguard your credentials.
  • You may not create accounts using automated means, or register multiple accounts to abuse the Free Trial or any promotional offer.

5 Acceptable Use Policy

You agree that you will NOT:

  • Generate, submit, or distribute fake, duplicate, or fraudulent Queue Tokens.
  • Interfere with, disrupt, or attempt to gain unauthorized access to any part of the App or its infrastructure.
  • Use automated bots, scripts, or tools to manipulate queue positions or token generation.
  • Use the App for any unlawful purpose, or in violation of any applicable law or regulation.
  • Harass, threaten, or abuse other Users, Businesses, or Company personnel.
  • Reverse-engineer, decompile, or attempt to extract source code from the App.
  • Sell, resell, license, sublicense, or otherwise commercially exploit your access to the App without prior written consent.
  • Upload or transmit any viruses, malware, or other harmful code through the App.
  • Attempt to circumvent any billing, subscription, or access control mechanism of the App.

Violation of this policy may result in immediate suspension or permanent termination of your account, and may be referred to applicable law enforcement authorities.

6 Free Trial — One (1) Month Complimentary Access

✦ Free Trial Grant

RMSS Innovations grants every new registered User a complimentary one (1) month free trial of the applicable Subscription Plan upon first account activation ("Free Trial Period"). No credit card or payment information is required to activate the Free Trial.

6.1  Eligibility & Conditions

  • The Free Trial is available exclusively to first-time registered Users and is limited to one (1) Free Trial per person and per business entity.
  • The Free Trial grants access to all features included in the chosen Subscription Plan for the full thirty (30) calendar days.
  • The Free Trial Period begins on the date of successful account registration and expires exactly thirty (30) calendar days thereafter.
  • Users who register multiple accounts to obtain additional Free Trial periods are in violation of Section 5 and may have all accounts terminated.
  • The Company reserves the right to modify or discontinue the Free Trial offer for new registrations at any time without affecting Free Trials already in progress.

6.2  Transition After Free Trial

  • Upon expiry of the Free Trial Period, your access will automatically suspended until a paid Subscription Plan is activated.
  • You will receive a reminder notification at least seven (7) days before the end of the Free Trial Period.
  • The Company shall not automatically charge any payment method at the end of the Free Trial unless you have expressly opted into auto-renewal with valid payment details on file.

7 Subscription Plans, Billing & Payments

7.1  Subscription Plans

  • After the Free Trial Period, continued access to premium features requires purchase of a Subscription Plan.
  • Available plans, pricing, features, and billing cycles are published on the App and the Company website and are subject to change with prior notice.
  • Subscription fees are charged in advance for the selected billing cycle (monthly or annually).

7.2  Technical Errors During Paid Subscription — No Refund Obligation

⚠ Important — No Refund for Technical Disruptions

In the event that technical errors, outages, service interruptions, bugs, data loss, or any other platform-related issues occur during a paid Subscription Period, the User acknowledges and agrees that RMSS Innovations shall have NO obligation to issue a refund, credit, or compensation of any kind.

This limitation applies because the Company has already provided a full one (1) month Free Trial, giving Users adequate opportunity to evaluate the service before committing to a paid plan. By subscribing to a paid plan, you expressly waive any claim for refund arising from technical errors or service disruptions.

  • While the Company endeavors to maintain high availability and promptly resolve technical issues, the App is provided on an "as-is" and "as-available" basis without warranties of uninterrupted service.
  • The Company's sole obligation upon a confirmed technical error during a paid subscription is to use commercially reasonable efforts to restore service within a reasonable timeframe.
  • Planned maintenance windows communicated at least 24 hours in advance shall not constitute a service disruption for purposes of this clause.
  • In exceptional circumstances (e.g., prolonged outages exceeding 72 consecutive hours), the Company may, at its sole and absolute discretion, offer a service credit as a goodwill gesture — this creates no ongoing legal obligation.

7.3  Cancellation Policy

  • You may cancel your Subscription Plan at any time through the App settings or by contacting contact@tokenwallah.in.
  • Cancellation takes effect at the end of the current billing cycle; you retain access to premium features until that date.
  • No prorated refunds are provided for unused portions of a billing cycle unless required by applicable law.
  • The Company reserves the right to cancel your subscription immediately in case of a violation of these Terms.

8 Queue Token Rules & Conduct

  • Queue Tokens are session-specific and expire upon completion, cancellation, or expiry of the relevant queue session.
  • Users must be available to respond within a reasonable time window when their token number is called. Failure to respond may result in the token being marked as "No-Show" and skipped.
  • Cancellation of a token after joining a queue is subject to the cancellation policy established by the individual Business/Merchant, not the Company.
  • The Company does not guarantee the accuracy of wait-time estimates; they are indicative only and may vary due to factors beyond our control.
  • Abuse of the token system — including generating phantom tokens, transferring tokens, or using automated means — constitutes a violation of Section 5.

9 Intellectual Property Rights

  • All content, features, functionality, branding, trademarks, logos, source code, design elements, and intellectual property associated with the App are owned by or licensed to RMSS Innovations.
  • You are granted a limited, non-exclusive, non-transferable, revocable license to use the App strictly in accordance with these Terms during the term of your subscription or Free Trial.
  • You must not reproduce, modify, distribute, publicly display, sublicense, or create derivative works based on the App or its content without the Company's prior written consent.
  • Any feedback, suggestions, or ideas you submit to the Company may be used by the Company without obligation of compensation or attribution to you.
  • "Token Wallah," "QueueSmart," and associated logos are trademarks or trade names of RMSS Innovations. Unauthorized use is strictly prohibited.

10 Privacy & Data Protection

  • Your use of the App is governed by our Privacy Policy, which is incorporated into these Terms by reference.
  • We collect, store, and process personal data in compliance with applicable data protection laws, including the Information Technology Act, 2000 (India) and applicable rules thereunder.
  • We implement industry-standard technical and organizational security measures to protect your data; however, we cannot guarantee absolute security of data transmitted over the internet.
  • You have the right to request access to, correction of, or deletion of your personal data by contacting us at contact@tokenwallah.in.

11 Disclaimers of Warranties

To the maximum extent permitted by applicable law:

  • THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
  • THE COMPANY EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • THE COMPANY DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
  • WAIT-TIME ESTIMATES AND QUEUE PREDICTIONS ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND ARE NOT GUARANTEED.

12 Limitation of Liability

To the maximum extent permitted by applicable law:

  • IN NO EVENT SHALL RMSS INNOVATIONS, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF REVENUE, LOSS OF DATA, MISSED APPOINTMENTS, BUSINESS DISRUPTION, OR REPUTATIONAL HARM.
  • THE COMPANY'S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE TOTAL SUBSCRIPTION FEES PAID BY YOU IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
  • THESE LIMITATIONS APPLY EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13 Indemnification

You agree to indemnify, defend, and hold harmless RMSS Innovations and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of or access to the App.
  • Your violation of any provision of these Terms.
  • Your violation of any third-party right, including intellectual property or privacy rights.
  • Any content or data you submit through the App.
  • Any fraudulent, negligent, or unauthorized activity by you or anyone using your account.

14 Termination & Suspension

  • The Company reserves the right to suspend, restrict, or permanently terminate your access to the App at its sole discretion, immediately and without prior notice, if you violate these Terms or engage in any activity that may harm the App, its infrastructure, other Users, or the Company.
  • Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination shall continue to apply, including Sections 9, 12, 13, and 16.
  • You may terminate your account at any time by following the account deletion procedure in the App or by contacting contact@tokenwallah.in.

15 Changes to These Terms

  • The Company may modify or update these Terms at any time. When material changes are made, we will notify you via in-app notification, email to your registered address, or a prominent notice on the App.
  • Your continued use of the App after the effective date of the revised Terms constitutes your acceptance of the new Terms.
  • If you do not agree to the revised Terms, you must cease using the App and may request account deletion.

16 Governing Law & Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
  • Any dispute shall first be attempted to be resolved amicably through good-faith negotiation within thirty (30) days of written notice.
  • If amicable resolution fails, disputes shall be subject to the exclusive jurisdiction of the competent courts located in Raipur, Chhattisgarh, India.
  • Nothing in this clause shall prevent either party from seeking urgent injunctive or equitable relief from a court of competent jurisdiction.

17 General Provisions

  • Entire Agreement: These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and the Company regarding the App.
  • Severability: If any provision of these Terms is found invalid or unenforceable, that provision shall be modified to the minimum extent necessary, and all other provisions shall remain in full force.
  • Waiver: The Company's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
  • Assignment: You may not assign your rights or obligations under these Terms without the Company's prior written consent. The Company may freely assign its rights.
  • Force Majeure: The Company shall not be liable for any delay or failure to perform arising from causes beyond its reasonable control, including natural disasters, acts of government, internet failures, or cyberattacks.
  • Notices: Legal notices to the Company must be sent to contact@tokenwallah.in. Notices to you may be sent to your registered email address.

Account & Data Deletion

You have the right to request deletion of your personal data from Token Wallah at any time. This page explains how to submit a deletion request and what happens after.

1 What Data Can Be Deleted

  • Your account profile (name, phone number, email)
  • Token history and queue activity logs
  • Device identifiers and push notification tokens
  • Any stored preferences and settings

2 How to Request Deletion

You can request data deletion through any of the following methods:

  • In-App: Go to Settings → Legal → Delete Account
  • Email: Send a request to contact@tokenwallah.in with subject "Data Deletion Request"

1 Frequently Asked Questions

How do I generate a token?

Open the Token Wallah app, find the shop or clinic you want to visit, and tap "Get Token". You'll receive a token number and estimated wait time instantly.

Can I cancel my token?

Yes — go to "My Tokens" in the app, tap the active token, and select "Cancel Token". Cancellation is allowed until the deadline set by the business.

What if I miss my turn?

If your token is called and you don't respond, it may be marked as skipped by the staff. Contact the shop directly or generate a new token if the queue allows it.

How do I get notified when my turn is near?

Make sure push notifications are enabled for the Token Wallah app in your phone settings. You'll receive an alert when your token is a few positions away.

I forgot my PIN. How do I reset it?

On the login screen, tap "Forgot PIN" and follow the steps to verify your phone number and set a new PIN.

2 For Business Owners

  • How do I open my queue? — Log in to the staff app, go to Dashboard, and tap "Open Queue". Set your daily token limit and average service time.
  • How do I pause the queue? — Tap the Pause button on the Dashboard. Customers will see a "Queue Paused" message and won't be able to join until you resume.
  • How do I set up the TV display? — Go to Settings → TV Display → Connect Display. Use the code shown to link your TV screen.
  • Can I add staff members? — Yes. Go to Settings → Staff Management to invite staff by phone number or email.
